1. DEFINITIONS

In these Terms:

- "AlarmZ", "we", "us", "our" — AlarmZ mobile app operated by Iman Clayton (sole proprietor).

- "App" — the AlarmZ iOS application.

- "User", "you" — any individual using the App.

- "Services" — all functionality provided by AlarmZ.

- "Premium Subscription" — paid subscription required to access the App.

- "AlarmKit" — Apple's system-level alarm framework.

- "Website" — the AlarmZ website at alarmz.app.

- "Third-Party Services" — Firebase, Superwall, Apple, Mixpanel, Squarespace, etc.

2. ACCEPTANCE OF TERMS

By downloading, installing, tapping "Continue" in the onboarding flow, or visiting our Website, you confirm that:

- You have read and understood these Terms

- You agree to be bound by these Terms and our Privacy Policy

If you do not agree, uninstall the App immediately.

We may modify these Terms at any time. Continued use of the App constitutes acceptance of updated Terms.

3. ELIGIBILITY

- Minimum age: 13

- If under 18, you confirm your parent/guardian has reviewed and accepted these Terms.

- You must comply with all applicable laws.

4. USER RESPONSIBILITIES

4.1 Device Requirements

AlarmZ requires:

- iOS 26+

- Notification permissions

- Background privileges

- A functioning speaker

We are not liable for failures caused by device settings.

4.2 Accuracy

Information provided to us must be correct.

4.3 Prohibited Uses

You may NOT:

- Reverse-engineer the App

- Use automation or bots

- Interfere with servers or security systems

4.4 Risk

Alarm failures can occur due to battery issues, OS behavior, hardware defects, revoked permissions, etc.

Do not rely on AlarmZ for critical or emergency wake-up needs.

5. APP LIMITATIONS

AlarmZ is not a medical or emergency service.

6. NO GUARANTEES

We do not guarantee specific results such as:

- Waking up on time

- Habit improvements

- Better productivity or sleep

7. PRIVACY & DATA

Data usage is described in the Privacy Policy. Key points:

- We collect alarm configurations and app preferences locally on your device.

- We use Firebase (sound library), Superwall (subscriptions), Apple (purchases), Mixpanel (analytics), and Squarespace (website hosting).

- Data is encrypted in transit.

- We do not store payment card numbers.

To remove all locally stored data, uninstall the App.

8. THIRD-PARTY SERVICES

We are not responsible for failures caused by Apple, Firebase, Superwall, Mixpanel, Squarespace, or other third-party systems.

9. SUBSCRIPTIONS, BILLING & TRIALS

9.1 Premium Subscription

AlarmZ requires an active subscription to use. A subscription gives you access to:

- Unlimited alarms

- Full sound library

- All tasks & difficulty levels

- Custom victory screens

- Favorites & quick picks

Trials:

- Yearly plan: 3-day free trial

- Monthly & weekly: no trial

Pricing examples:

- Yearly: ~39.99 (localized)

- Monthly: ~4.99

- Weekly: ~1.99

(App Store defines the final price.)

9.2 Auto-Renewal

All subscriptions renew automatically unless canceled in your Apple ID settings.

You may cancel any time before the renewal timestamp shown in your Apple subscription settings.

Uninstalling the App does not cancel your subscription.

9.3 Refunds

Handled exclusively by Apple via:

10. INTELLECTUAL PROPERTY

10.1 AlarmZ IP

All content created by or for AlarmZ—including sounds, UI, images, and code—is owned by AlarmZ or its licensors.

10.2 License to Use the App

You receive a personal, non-transferable, revocable license to use the App.

10.3 Copyright Complaints

11. TERMINATION

We may terminate or suspend your access to the App if you violate these Terms.

12. WARRANTY DISCLAIMER ("AS IS")

AlarmZ is provided as is without warranties of any kind.

No guarantee of:

- uptime

- accuracy

- reliability

- compatibility

13. LIMITATION OF LIABILITY

Maximum liability is the greater of:

- CHF 50, or

- The amount you paid to us in the last 12 months

We are not liable for missed alarms, lost data, financial loss, harm, or any indirect damages.

14. INDEMNIFICATION

You agree to indemnify and hold AlarmZ harmless from claims arising out of:

- misuse of the App

- violation of these Terms

15. GOVERNING LAW

These Terms are governed by the laws of Switzerland.

Mandatory consumer rights in your jurisdiction still apply.

16. DISPUTE RESOLUTION

Where legally permitted, disputes shall be resolved through individual arbitration.

Class actions are waived to the extent permitted by law.

17. MISCELLANEOUS

- These Terms are the entire agreement between you and AlarmZ

- Invalid provisions do not affect the rest

- We may assign our rights; you may not

18. CHANGES TO TERMS

We may update these Terms at any time.

Continued use = acceptance.
